Terms of use.

These terms set out the basis on which you may access and use the Rayamp Solar website. Please read them carefully. By using the site, you agree to be bound by them.

1. Introduction

This website at rayampsolar.com.au (the site) is operated by Rayamp Solar Pty Ltd (Rayamp Solar, we, us or our), a Victorian residential solar and battery installer. These Terms of Use (Terms) govern your access to and use of the site.

By accessing or using the site you agree to these Terms. If you do not agree, please do not use the site. These Terms apply to the website only. Any installation, supply or services we provide to you are governed by a separate written contract agreed at the time of engagement.

2. Definitions

In these Terms:

  • ACL means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
  • Content means all text, graphics, images, logos, photographs, audio, video, data, software and other material published on the site.
  • Services means the residential solar and battery design, supply, installation and related services we offer.
  • You means any person who accesses or uses the site.

3. Use of the website

You may use the site for lawful personal and non-commercial purposes only, including to learn about our Services, request a quote or assessment, or contact us. When you use the site you must not:

  • use the site in a way that breaches any applicable law or regulation;
  • interfere with, disrupt or attempt to gain unauthorised access to the site, its servers, or any connected network;
  • introduce any virus, trojan, worm, logic bomb or other harmful material;
  • scrape, harvest, mirror or systematically extract Content from the site without our prior written consent;
  • use the site to transmit unsolicited commercial communications; or
  • impersonate any person or misrepresent your affiliation with any person or entity.

We may suspend or restrict access to the site at any time without notice.

All Content on the site is owned by or licensed to Rayamp Solar and is protected by Australian and international copyright, trade mark and other intellectual property laws. The Rayamp Solar name, logo and brand marks are trade marks of Rayamp Solar Pty Ltd.

You may view and download Content for your personal, non-commercial use only. Except as permitted by law, you must not reproduce, adapt, communicate, publish, distribute or commercially exploit any Content without our prior written consent.

5. Information you submit

When you submit information through the site — for example, via our contact form or when requesting a quote — you must ensure that the information is true, accurate, current and complete. You are responsible for the content of any information you provide.

Information submitted through the site is not treated as confidential unless we expressly agree otherwise in writing. Please do not send us sensitive information through the contact form. We handle the personal information you provide in accordance with our Privacy Policy.

6. Quotes and assessments

Any quotes, estimates, assessments, savings figures, payback periods, rebate amounts or system recommendations presented on the site, or provided in response to an enquiry, are indicative only. They are based on the information available to us at the time and on general assumptions about typical Victorian homes, tariffs and rebate programs.

Indicative figures are not an offer capable of acceptance and do not form a binding agreement. A binding installation or supply contract only exists once a formal written quote has been issued and accepted in writing by both you and Rayamp Solar. Actual pricing, rebate eligibility and system performance will depend on site inspection, product availability, your retailer and distributor, and the rules of any government or industry rebate program in force at the time of installation.

7. Third-party links and content

The site may contain links to third-party websites, including government rebate pages, energy retailer sites, manufacturer pages and industry resources. These links are provided for convenience only. We do not control, endorse or accept responsibility for the content, products, services or availability of any third-party website.

Your use of any third-party website is at your own risk and subject to the terms and privacy policies of that site.

8. Disclaimers and limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified.

Subject to the paragraph above, the site and its Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Rayamp Solar makes no representations or warranties of any kind, express or implied, as to the operation of the site, its accuracy, reliability, completeness, currency, or suitability for any particular purpose.

To the maximum extent permitted by law, Rayamp Solar and its directors, employees, contractors and suppliers are not liable to you for any loss, damage, cost or expense (including indirect, special, consequential or economic loss, loss of profits, loss of data or loss of business opportunity) arising out of or in connection with your use of, or inability to use, the site or any Content, whether in contract, tort (including negligence), statute or otherwise.

Where our liability cannot be excluded but may be limited, our liability is limited, at our option, to the re-supply of the relevant information or services, or the payment of the cost of having the relevant information or services re-supplied.

To the maximum extent permitted by law, you agree to indemnify and hold harmless Rayamp Solar and its directors, employees and contractors from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable legal costs) arising out of or in connection with your breach of these Terms or your misuse of the site.

11. Governing law

These Terms are governed by the laws of Victoria, Australia. You and Rayamp Solar each submit to the exclusive jurisdiction of the courts of Victoria and the courts of appeal from them for any dispute arising out of or in connection with these Terms or your use of the site.

We may update these Terms from time to time. The current version will always be available on this page, along with the date it was last updated. Your continued use of the site after any changes means you accept the updated Terms. If you do not agree to any change, you should stop using the site.
